Terms and Conditions

Welcome to the MoVa website. These Terms and Conditions govern your use of our website and services, including the purchase of products, the Wardrobe in Motion membership, and Rent & Try.

By accessing or using this website or placing an order with MoVa, you agree to these Terms and Conditions and any additional terms applicable to the service you use. Mandatory statutory consumer rights remain unaffected.

2. Products and Services

MoVa offers ready-to-wear garments through direct purchase, the Wardrobe in Motion membership, and, where available, the Rent & Try option.

Products, garments, sizes, and services are subject to availability. MoVa reserves the right to modify or discontinue products or services, subject to existing contractual obligations and applicable law.

Product images and descriptions are intended to represent our garments as accurately as reasonably possible. Minor variations in colour, appearance, materials, or finishing may occur, including as a result of screen settings, photography, or the characteristics of individual materials.

3. Wardrobe in Motion Membership

Wardrobe in Motion is available through different membership plans, including Essential and Classic. The number of garments that may be held at one time depends on the selected membership plan.

Membership has an initial minimum term of six months. The first two months are payable in advance, after which the applicable membership fee is billed monthly.

After the initial six-month term, the membership continues for an indefinite period and may be cancelled with a notice period of one month.

All garments provided through Wardrobe in Motion remain the sole property of MoVa at all times. Membership grants members a temporary right to possess and use the garments and does not transfer ownership.

Membership plans, payments, unlimited exchanges, garment availability, care, damage, loss, returns, payment failure, cancellation, and other membership-specific conditions are governed by our Membership Subscription Terms.

4. Rent & Try

Where available, Rent & Try allows customers to pay the full item price upfront and use the garment for up to 90 days before deciding whether to keep it, return it, or, where applicable, join Wardrobe in Motion.

Returns, refunds, applicable cleaning, logistics and shipping costs, garment condition requirements, and any applicable membership credit are governed by the conditions displayed at the time of purchase and our Returns & Refunds Policy.

Rent & Try is a voluntary MoVa service and does not limit any mandatory statutory consumer rights that may apply.

5. Orders and Payment

Prices are displayed in Euros and include VAT where applicable, unless otherwise stated.

The applicable total price, including any shipping charges payable to MoVa, will be displayed before the order is placed.

For deliveries to destinations outside the European Union, additional import duties, import VAT, customs clearance fees, or other charges may apply. Unless expressly stated otherwise at checkout, these charges are the responsibility of the customer as described in our Shipping & Delivery Information.

We accept the payment methods displayed during checkout. Payments may be processed by third-party payment service providers.

Orders are subject to confirmation and availability. MoVa reserves the right to refuse or cancel an order where reasonably necessary, including in cases of product unavailability, pricing or technical errors, suspected fraud or misuse, payment issues, or where we are otherwise unable to fulfil the order.

Where payment has already been collected for an order that MoVa subsequently cancels, the applicable amount will be refunded in accordance with applicable law.

6. Shipping, Returns and Withdrawal

We currently ship within the European Union and Schengen area. Shipping destinations, delivery times, shipping costs, customs charges, and related conditions are set out in our Shipping & Delivery Information.

Consumers generally have a statutory right to withdraw from eligible distance contracts. For standard online purchases, the withdrawal period is generally 14 days.

Further information regarding withdrawal, returns, refunds, return costs, garment condition requirements, Rent & Try returns, and membership returns can be found in our Returns & Refunds Policy and, where applicable, our Membership Subscription Terms.

Nothing in these Terms limits mandatory statutory consumer rights.

7. Care and Maintenance

Membership garments are professionally cleaned and inspected before being returned to circulation. MoVa conducts quality checks and repairs as needed before placing membership garments back into circulation.

Purchased garments should be cared for in accordance with the individual care instructions provided with each product.

Care, cleaning, damage, and repair obligations relating specifically to Wardrobe in Motion garments are governed by our Membership Subscription Terms.

8. Intellectual Property

All content on this website, including images, photographs, text, graphics, logos, branding, designs, videos, and other materials, is owned by MoVa or used with the permission of the relevant rights holder and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, commercially exploit, or otherwise use such content without prior written permission from MoVa or the relevant rights holder, except where permitted by applicable law.

9. Limitation of Liability

MoVa is liable without limitation where liability cannot be excluded or limited by applicable law, including in cases of intent or gross negligence and for injury to life, body, or health.

In cases of ordinary negligence, MoVa shall only be liable for the breach of essential contractual obligations, and such liability shall be limited to damages that were reasonably foreseeable at the time the contract was concluded.

Nothing in these Terms excludes or limits any statutory rights or liability that cannot legally be excluded or limited.

10. Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Germany, without prejudice to mandatory consumer protection provisions applicable in the consumer's country of habitual residence.

11. Changes to These Terms

MoVa may update these Terms and Conditions from time to time, including to reflect changes to our services, business operations, technical systems, or applicable legal requirements.

Any updated version will be published on this page with a revised “Last updated” date.

Changes will not retrospectively affect rights or obligations that have already arisen. Changes affecting existing contractual relationships will apply only where permitted by applicable law or where any required agreement or consent has been obtained.

Specific provisions regarding changes to ongoing Wardrobe in Motion memberships are set out in our Membership Subscription Terms.

Depending on the products or services you use, additional terms and policies may apply, including our:

The Membership Subscription Terms form part of the contractual terms applicable to Wardrobe in Motion memberships. In the event of a conflict between these general Terms and Conditions and the Membership Subscription Terms regarding a membership-specific matter, the Membership Subscription Terms shall prevail.

The Returns & Refunds Policy and Shipping & Delivery Information contain additional conditions and information applicable to orders, returns, refunds, exchanges, deliveries, and customs.

The Privacy Policy and Cookie Policy explain how personal data and cookies or similar technologies are handled.

Nothing in these Terms or the referenced policies excludes or limits mandatory rights available to consumers under applicable law.
